These Terms of Service ("Terms") govern access to and use of Populica (the "Service"), operated by Cantueso Corp / Cipion Marketing ("Populica," "we," "us"). By creating an account or using the Service, you agree to these Terms.
Populica generates AI-assisted audience research, campaign strategy and advertising creative based on information you provide about your company, its website and its sector. Outputs are generated using third-party AI models (including Google Gemini) and are provided as a starting point for your own marketing work, not as guaranteed, verified, or legally compliant claims about any market, audience or individual.
You must provide accurate information when creating an account and are responsible for activity under your account and for keeping your password confidential. You must be at least 18 years old and authorized to act on behalf of any company you add to the Service.
Paid plans are billed monthly or annually through Stripe, our payment processor. By subscribing, you authorize recurring charges at the then-current price for your plan until you cancel. Annual plans are billed upfront for the full year. You can cancel at any time from inside the app or by emailing hello@populica.com; cancellation stops future renewals but does not refund the current billing period unless required by law. We may change plan pricing with at least 30 days' notice before it applies to your next renewal.
You agree not to: use the Service to generate content that is unlawful, defamatory, or that misrepresents real, identifiable individuals as customers, reviewers or endorsers; attempt to reverse-engineer, scrape at scale, or resell the Service without a written agreement; exceed your plan's usage limits through automated abuse; or upload content you do not have the right to use as a research input.
As between you and Populica, you own the audience personas, campaign strategy text and ad creative generated for your account, subject to the underlying rights of the AI providers whose models were used and any third-party assets (such as stock elements) they may draw on. Populica retains ownership of the Service itself, including its software, design and the "sector pack" frameworks used to generate research.
Audience personas, statistics, compliance notes and creative concepts are AI-generated starting points. They are not verified market research, legal advice, or compliance sign-off for regulated industries (including financial services, healthcare or insurance). You are responsible for verifying any claim before using it in a real campaign, and for your own industry's advertising and compliance rules.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms, misuse the Service's AI generation features, or fail to pay applicable fees, with notice where reasonably possible.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Populica is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above, and continued use of the Service after a change means you accept the update.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
